About these terms
These terms apply to the website at taftan.io and to the Taftan app. The developer of Taftan ("we", "us", "our") provides both. You can contact us at [email protected].
When you use the website or the app, you accept these terms. If you do not accept them, do not use the website or the app.
Nothing in these terms affects your legal rights as a consumer. Those rights apply in addition to these terms, and these terms cannot take them away.
Using Taftan
You can use the website and the app for any lawful purpose. You must not:
- use them to break any law, or to harass, threaten or harm anyone;
- send, through the app, material that you have no right to send;
- try to damage, overload or get unauthorised access to the website or the servers behind it;
- use the website or the app to infringe the rights of anyone else.
You are responsible for the messages that you send and for the passphrases that you choose. You are also responsible for checking whether you can lawfully use the app where you are. Read our Export, Sanctions and Personal Risk page before you use the app in a country that restricts communication.
Keep the sound channel at a comfortable volume. Do not play it loudly near anyone's ears.
A free service, with no promises beyond the law
We provide the website and the app free of charge. We take reasonable care, but we cannot promise that they will always be available, that they will be free from errors, or that a message will always arrive.
Encryption protects the content of a message. No software can protect against every risk, for example a weak passphrase, a compromised phone, or a person who watches you.
To the extent the law allows, we provide the website and the app "as is". We give no promise about them other than the promises that the law implies and does not let us exclude.
Our responsibility to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit.
If you are a consumer, we are responsible for loss or damage that you suffer and that is a foreseeable result of our breaking these terms or of our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if we and you both knew that it could happen when you started to use the app. We are not responsible for loss or damage that is not foreseeable.
If the app damages a device or digital content that belongs to you, and the cause is our failure to use reasonable care and skill, we will repair the damage or pay you fair compensation.
We supply the website and the app for domestic and private use. If you use them for a business purpose, we are not liable to you for loss of profit, loss of business, interruption of business or loss of a business opportunity. To the extent the law allows, our total liability to a business user is limited to 100 pounds sterling. We think this limit is reasonable because the website and the app are free.
The app keeps no copy of your messages or your passphrase. If you lose a passphrase, nobody can recover the message, including us.
If you misuse Taftan
If you break these terms or the law when you use the website or the app, and someone makes a claim against us because of it, you are responsible for the reasonable losses and costs that the claim causes us. This applies only to the extent the law allows. It does not apply to anything that we caused.
Licence and intellectual property
Taftan is proprietary software. It is not released under an open source licence. We own, or have a licence to use, the copyright and other rights in the website and the app, including their text, design, code, name and logo. Do not use the Taftan name or logo in a way that suggests we support you or your product.
We give you a free, personal, non-exclusive and non-transferable licence to download, install and use the app on devices that you own or control, for lawful purposes.
You can give an unchanged copy of the official Android app file (APK), exactly as we publish it, to another person free of charge, for example during an internet shutdown. The person who receives it gets the same licence from us under these terms.
You must not change, repackage or re-sign the app, or distribute a changed copy. You must not charge money, or ask for anything else, in return for a copy. You must not say or suggest that you are the official source of Taftan or that we have approved your copy, and you must not present the app as your own. You must not reverse engineer or decompile it, except where the law gives you that right and does not let us restrict it.
A copy that you receive from another person may have been changed. Before you install it, check that the SHA-256 checksum of the file matches the checksum on our Downloads page. If it does not match, do not install it.
You can print or save pages of the website for your own reference.
Links to other sites and services
The website links to sites and services that we do not control, such as Google Play, Matrix and our related projects. We are not responsible for their content or for how they handle your data. Their own terms apply when you use them.
Changes to these terms
We can change these terms, for example when the law or the app changes. We will publish the new version on this page with a new date. If a change has a significant effect on you, we will say so on this page. The version in force on the day you use the website or the app applies to that use.
Governing law and disputes
The law of England and Wales governs these terms. You can bring a claim in the courts of England and Wales.
If you live in Scotland or Northern Ireland, you can also bring a claim in the courts of the country where you live.
If you are a consumer who lives in another country, you keep the protection of the mandatory consumer laws of that country. You can bring a claim in the courts of that country where its law allows.
Other terms
- If a court decides that part of these terms is not valid, the rest of the terms continue to apply.
- If we do not enforce a term immediately, we can still enforce it later.
- Only you and we have rights under these terms. No other person can enforce them.
